Additional restrictions on Amazon - which products do they refer to?
2 Sept 2024
Selling on Amazon involves the necessity of adhering to many regulations aimed at ensuring the safety and quality of the products offered. We have prepared a detailed overview of the categories subject to additional restrictions and guidelines on how to meet these requirements so that your products comply with all platform standards.
Products subject to REACH regulation
The REACH regulation (Registration, Evaluation, Authorisation and Restriction of Chemicals) is a key regulator for the sale of chemicals in the EU, focusing on the safe use of these substances. Products covered by this regulation that may be considered hazardous and require HAZMAT processing include:
Chemical products: cleaning agents, construction chemicals
Some cosmetics
Fertilisers
Biocidal products: e.g. mosquito, ant, spider sprays
Batteries
For products subject to HAZMAT processing offered in the FBA model, it is necessary to provide a safety data sheet/hazardous substance sheet. This document provides Amazon with information on whether the products can be offered on the platform, and in the case of FBA, how they should be transported and stored. Some of them also require an expiry date.
Additional requirements apply to jewellery. Sellers must provide a REACH declaration from the manufacturer or test reports demonstrating compliance with limits for cadmium, nickel, and lead in order to obtain approval for sale.
Products for children
Sellers of children’s products must present a CE declaration confirming the product's compliance with EU guidelines. It is also necessary to provide physical photographs of the products or packaging confirming that they have been labelled CE in accordance with the regulation. Furthermore, the listing should include information about the age group for which the product is intended.
Electronics
WEEE (Waste Electrical and Electronic Equipment) registration is essential for electronics sellers in Germany. Registration provides companies with a WEEE number, which is necessary for selling electrical devices on Amazon. The Electrical and Electronic Equipment Act (ElektroG) implements the WEEE directive in Germany, requiring registration with the EAR Foundation. Each seller must provide this number in the Amazon panel, which is verified by the marketplace. It must be obtained for each brand and type of equipment that we offer.
WEEE equipment categories include:
Discharge lamps
Large and small photovoltaic panels
Large and small appliances
Displays
Small IT and telecommunications equipment
Temperature exchange devices
Products with energy labels
For products that affect energy consumption, such as lighting, electronic displays, washing machines, dishwashers, tumble dryers, and refrigerators, it is required to provide an energy label. This label shows on a scale from A to G how much energy the device consumes. Information about the energy class must be provided in the product information, and the product must include an information sheet in the language of the country of sale and be registered in the EU product database EPLER.
Distributors of electronic products must ensure that their suppliers meet all requirements in the specific product category.
Summary
Selling on Amazon requires sellers to meet many rigorous requirements and regulations to ensure the safety and quality of the products offered. Compliance is essential for success in the market and for ensuring customer trust. Need help? We are here for you!
